1. Limited Warranty. Menusifu offers a limited warranty (“Limited Warranty”) to cover substantial defects in materials and workmanship in the new Menusifu System Customer has purchased directly from Menusifu under an Order Form. This Limited Warranty applies only to the hardware products that Customer purchased directly from Menusifu under Order Forms (excluding any tablet products such as iPad Menusifu purchases at Customer’s request) and installed by a Menusifu representative or authorized agent (“Hardware”). If Customer discovers a defect in any Hardware and notify Menusifu in accordance with the terms hereof, Menusifu will, at its option, repair or replace Customer’s Hardware (with the substantially same or similar model, which may or may not be a refurbished model) at no charge for either parts or labor (subject to the terms hereof). This Limited Warranty does not apply if Menusifu determines in its sole discretion that damage to the Hardware has been caused by abuse, negligence, accident, misuse, loss, theft, normal wear-and-tear, improper transportation, installation (not completed by a Menusifu representative or authorized agent), manufacturing defects not attributable to Menusifu, acts of God, such as hurricanes or floods, or servicing (upgrading, expansion, disassembly, repair, or other modification) by anyone who is not specifically authorized by Menusifu.
2. Disclaimers. This Limited Warranty does not guarantee Customer’s uninterrupted use of the Menusifu System. Neither Menusifu nor its employees or authorized agents shall be liable for direct or indirect damages Customer may experience including, but not limited to, loss of revenue or profits, downtime, other incidental or consequential damages or damage to or replacement of equipment and property, and loss of data as a result of any defects covered by this Limited Warranty. Prior to returning any defective Hardware to Menusifu, please contact Menusifu Support to receive a Return Material Authorization (“RMA”) number (See Return Policy below).
3. Warranty Period. This Limited Warranty shall apply for one (1) year following the date of Customer’s purchase of the Menusifu system. Additionally, this Limited Warranty may be applied retroactively to any Hardware sold by Menusifu to any of its customers between February 1, 2017 and February 1, 2018.
4. Return Policy
4.1 Return Period. If Customer has an issue with any Hardware, please contact Menusifu Support at 888809-8867 or support@menusifu.com before Customer attempts to return it to Menusifu. If a Menusifu Support Representative has given Customer an RMA number in advance, Menusifu will replace Your product with a new or refurbished replacement unit at Menusifu’s sole discretion via regular ground service by the next business day. Customers may request shipping methods other than ground service at their own expense. Customer must return to Menusifu each covered Hardware via reputable parcel providers for which a replacement part was received within thirty (30) calendar days from receiving the replacement part (“Return Period”) using the return label enclosed with the replacement part. If Menusifu does not receive the covered Hardware from Customer within the Return Period, or receives the covered Hardware after the Return Period, or the shipment is incomplete, Customer acknowledges and understands that Menusifu will charge Customer the then-prevailing retail price of the replacement part. Returns must be shipped (with provided shipping labels) to the address indicated on the shipping documents. Each RMA is valid for thirty (30) days from the date of issuance. All returned product must be shipped to Menusifu with proper packaging so as to ensure safe and secure transportation. Menusifu shall not be liable for any lost or damaged returns. Menusifu reserves the right to refuse returns attempted after thirty (30) days following date of original shipment, or any returns not meeting the above requirements.
4.2 Required RMA. Any and all Hardware returns to Menusifu must be accompanied by a RMA number issued by Menusifu’s Support. Returns are not valid without this number. Any Hardware returned without the number maybe rejected and returned to the original shipping address. Each return shall have the associated RMA number printed on each individual package. Menusifu reserves the right to refuse any returns not meeting the above requirements.
4.3 Other Conditions. Any Hardware returned that are found to be in a condition that is in contravention of the applicable warranty and/or that is found to be neglected, abused or otherwise tampered with will not be considered for repair or return and charges may apply. Any Hardware that is returned as defective that is not found by Menusifu to be defective will be retested, certified and returned. Charges may apply in such instance. Menusifu, in sole discretion may repair or replace Customer’s Hardware with an equivalent product or credit Customer the purchase.
4.4 Return Address. Customer agrees to ship the returning products under any given RMA number only to Menusifu Inc. at the address designated by Menusifu Support. Hardware returned must be in the original or similar packaging including the documentation and accessories with the relevant RMA number marked on each packaging.
